Demand Notices Issued by the State Excise Department - FY 2021-22 FL-3 Licence Fee

Greetings in the 76th year of the Hotel And Restaurant Association (Western India)!
It has come to our notice that the State Excise Department, Chhatrapati Sambhajinagar, has issued demand notices dated 29th July 2026 to FL-3 licence holders, calling upon them to pay the balance 50% licence fee and arrears, along with applicable interest, for the renewal of FL-3 licences for the financial year 2021–22.
HRAWI has taken up the matter and has addressed the concerned State Excise Department, clarifying that the demand notices are contrary to the interim orders passed by the Hon'ble Supreme Court in Special Leave Petition (Civil) No. 5852 of 2022.
In its representation, HRAWI has pointed out that:
- The Hon'ble Supreme Court, by its Order dated 31st March 2022, directed that the interim Order dated 6th May 2021 passed by the Hon'ble Bombay High Court shall continue until further orders.
- The Order dated 6th May 2021 protects the concerned licence holders who had complied with the directions of the Hon'ble High Court by depositing 50% of the licence fee.
- The matter is presently pending before the Hon'ble Supreme Court, and the interim protection granted by the Court continues to remain in force.
Accordingly, HRAWI has requested the State Excise Department to recall the demand notices and await the final decision of the Hon'ble Supreme Court.
